Impatriates: Changes to Accessing the IRPF Tax Benefit.
Individuals who become tax residents in Uruguay may, on a one-time basis, elect to pay the Non-Resident Income Tax (IRNR) instead of IRPF on their foreign-source capital income.
This benefit allows them to remain exempt from Uruguayan taxation on such income during the year of arrival and the following ten years. This is known as the impatriate regime.
To qualify for this regime, one of the following conditions must be met:
- Investment in real estate
Invest more than 12,500,000 UI, approximately USD 2 million, in real estate acquired on or after September 1, 2025.
Recent Decree No. 225/026 clarified that these properties must be valued based on their tax cost and may be the same properties taken into consideration for obtaining tax residency.
In addition, where the properties are urban real estate located in departments without a coastline on the Río de la Plata or the Atlantic Ocean, the tax cost will be increased by 100%.
- Contributions to investment funds.
Contribute at least 625,000 UI per year, approximately USD 100,000, to investment funds intended to finance productive or research and innovation projects.
Meanwhile, the Competitiveness and Cost of Living Reduction Bill, currently under consideration by Parliament, proposes expanding this alternative by allowing contributions to be made to other investment vehicles or, under certain conditions, as donations to non-profit organizations that finance cultural, educational, scientific, technological, or innovation projects.
The bill also provides that these funds may not be allocated to the taxpayer’s own projects or to projects of related companies.
An additional consideration.
Individuals who become Uruguayan tax residents on or after January 1, 2026, by remaining in Uruguay for more than 183 days during each fiscal year, may elect to pay IRNR without having to meet the investment requirements mentioned above.
A relevant regime for individuals considering establishing tax residency in Uruguay and planning their investments.
